WhatsApp Users in South Africa Will No Longer Lose Accounts Over Privacy Terms

WhatsApp has officially settled its dispute with South Africa’s Information Regulator regarding its privacy policy, ending a legal battle that began in January 2021. The messaging platform, owned by Meta, had faced criticism for requiring users to accept new terms of service or risk losing access to their accounts.

Background of the Dispute

In early 2021, WhatsApp notified users that they needed to accept updated privacy policies by February 2021. The new policy allowed the sharing of certain data across Meta’s platforms, raising significant privacy concerns. While WhatsApp maintained that messages would remain end-to-end encrypted, many South Africans were uncomfortable with the changes.

The dispute focused on whether WhatsApp could legally compel users to accept the updated terms under South African law.

Settlement Terms

According to Information Regulator Chairperson Pansy Tlakula, the settlement requires WhatsApp to:

  • Clarify its privacy policy in line with South Africa’s Protection of Personal Information Act (POPIA).
  • Ensure user consent is legally valid, well-documented, and not coerced.
  • Provide evidence of compliance with the regulator.

This means South African users can now continue using WhatsApp without being forced to accept the new terms.

Implications for Digital Privacy

The settlement is seen as a major victory for digital privacy in South Africa. Key impacts include:

  • Strengthened enforcement of POPIA.
  • Clearer guidance for tech platforms on obtaining legally valid consent.
  • Protection of user trust and transparency in data practices.

Experts note that this could influence global privacy practices, especially in countries with strict data protection regulations.

Benefits for Users and WhatsApp

  • Users gain better insight and control over how their data is shared.
  • WhatsApp avoids potential fines or legal penalties while maintaining its user base in South Africa.
  • The settlement reinforces the principle that platforms cannot coerce consent for broad data-sharing terms.

This resolution underscores the importance of clear, legally compliant privacy policies and sets a precedent for tech companies operating in regions with stringent data protection laws.
